Filmset hosts and delivers wedding films and photographs on behalf of the studios who make them. This document says what we owe each other. The section on deletion is the one that matters most, and it is written to be understood.
In this document we, us and Filmset mean the business that operates the Filmset service at filmset.co.
You means the studio — the photographer, filmmaker or company that opens an account and uploads work. This agreement is between us and you.
The couples and clients who open a gallery are not party to this agreement. Their relationship is with the studio who delivered the gallery to them, and whatever that studio promised them is the studio's promise, not ours. What we owe those viewers is set out in the Privacy Policy.
By opening an account or uploading anything you accept these terms. If you do not accept them, do not use Filmset.
You keep every right you hold in the films, photographs and other material you upload. We claim no ownership of any of it, ever.
You give us a limited licence, for as long as we hold your files, to store, copy, encode, resize and transmit them for the single purpose of running the service for you: making the streaming versions and thumbnails, building the galleries, and delivering them to the people you send the link to.
We will not use your work to advertise Filmset — on our website, in an email, on social media or anywhere else — without asking you first and getting your agreement in writing. If we ever want to show what someone made with the product, we will ask.
The licence ends when the files are deleted, except that copies may persist briefly in backups and caches while they cycle out.
When you upload something you are telling us that:
Material that sexually exploits a child will be reported to the authorities and the account closed immediately, without notice.
Storage is bought per project, priced per gigabyte, and charged when you upload. It is rounded up to the whole gigabyte. The current price is shown in the app before you confirm, and that price is what you pay.
Storage is consumed, not rented. Once bought it belongs to that project:
We may change prices. A change never applies to storage you have already bought.
Every project runs two clocks. Both start with the first upload into it, and every gallery in the project shares them.

Extending a project before a deadline moves that deadline. Nothing extends it afterwards.
We cannot recover deleted files. There is no hidden copy, no archive and no support request that will bring them back. Extending a project afterwards does not return anything that has already gone.
You must keep your own copies of everything you upload. If your only copy of a wedding is on Filmset, you do not have a copy. This is true of every platform, ours included, and it is the one thing in this document we would ask you to act on today rather than read past.
We send a reminder 30 days and again 7 days before each deadline, to you and to any client addresses you have added. Email is not guaranteed to arrive, and we are not able to guarantee it. Not receiving a reminder does not extend a deadline and does not make us responsible for what is deleted. Both dates are shown on the project page from the day you first upload, and that page is the record.
Extending client access is priced per gigabyte per year and charged when you extend. Extending keeps a gallery online; it never brings back originals that have already been deleted.
Premium is billed annually per studio and renews automatically until you cancel. Cancelling stops the next renewal — the term you have paid for runs to its end. If we remove a material Premium feature we will tell you, and you may cancel for a pro-rata refund of the unused part of the term.
The volume plan is an annual upload allotment for one studio, billed up front and renewed automatically on its anniversary from the card on file unless you cancel at renewal. The allotment covers every project in that studio; uploads draw from it until it is used up, after which storage is charged per gigabyte as usual. Once used, used: deleting a project or a gallery returns nothing to the allotment, and what is unused at the end of the year does not carry over. If a renewal payment fails, uploads pause until it is paid; galleries stay online and nothing is deleted by the failure itself — though the clocks in section 06 keep running throughout.
If you believe something on Filmset infringes your copyright, write to support@filmset.co with: your contact details, identification of the work, the gallery address where it appears, a statement that you believe in good faith the use is not authorised, a statement that your notice is accurate, and your signature.
We may remove or disable the material and tell the studio who uploaded it, who may send a counter-notice. Accounts that repeatedly infringe will be closed.
You may close your account whenever you like. Download everything you want to keep first — closing begins deletion, and after thirty days the files are gone.
We may suspend or close an account that breaches these terms, does not pay, or is being used unlawfully. Except where the law or someone's safety requires us to act immediately, we will tell you what is wrong and give you a fair chance to fix it and to export your work.
We work hard to keep Filmset running and we do not promise that it will be uninterrupted or free of faults. To the fullest extent the law allows, Filmset is provided as is, without warranty of any kind, express or implied.
We may change or withdraw features. If we ever decide to shut Filmset down entirely we will give you at least 90 days' notice and keep downloads working throughout, so you have time to take everything with you.
To the fullest extent permitted by law, our total liability to you for all claims arising out of or relating to Filmset is limited to the amount you paid us in the twelve months before the claim arose.
We are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost business, lost goodwill, or lost or deleted files, even if we had been told such loss was possible.
Nothing here limits any liability that cannot be limited by law.
You agree to defend and indemnify us against any claim, loss or cost arising from the material you upload, your use of Filmset, your breach of these terms, or your own agreements with your clients.
We may revise this document. If a change is material we will email the address on your account at least 30 days before it takes effect. Continuing to use Filmset after that means you accept the revised terms. If you do not, close your account before the change takes effect.
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Please talk to us first. Write to support@filmset.co describing the problem and give us 30 days to put it right. Most things are settled this way.
If that fails, any dispute will be brought in the state or federal courts located in Texas, and we each consent to the jurisdiction of those courts.
